In addition, the State’s Attorney must also prove that the Defendant Did Cause Serious Physical Injury to Another Person.<\/p>\n\n\n\n If you are charged under Subsection (a)(2), also known as the Intentional with a Deadly Weapon Subsection, the Essential Elements the State’s Attorney must prove are:<\/p>\n\n\n\n In plain English, this means that the State’s Attorney will have to prove Three things. First, that the Defendant Specifically Intended to Cause Physical Injury to Another Person. Physical Injury means impairment of physical condition or pain. In addition, the State’s Attorney must also prove that the Defendant Did Cause Serious Physical Injury to Another Person. Finally, the State’s Attorney must also prove that the Defendant Caused the Injury by means of a Deadly Weapon or Dangerous Instrument other than the Discharge of a Firearm.<\/p>\n\n\n\n If you are charged under Subsection (a)(3), also known as the Reckless with a Deadly Weapon Subsection, the Essential Elements the State’s Attorney must prove are:<\/p>\n\n\n\n In plain English, this means that the State’s Attorney will have to prove Three things. <\/p>\n\n\n\n First, that the Defendant Recklessly Caused Serious Physical Injury to Another Person. Under these Circumstances, Recklessness is a State of Mind where the Defendant is aware of and Consciously Disregards a Substantial and Unjustifiable Risk that his or her Actions could Seriously Physically Injure Another Person. Serious Physical Injury means physical injury which creates a substantial risk of death, or which causes serious disfigurement, serious impairment of health or serious loss or impairment of the function of any bodily organ. <\/p>\n\n\n\n Second, the State’s Attorney must also prove that the Defendant did Cause Serious Physical Injury to Another Person.<\/p>\n\n\n\n Finally, the State’s Attorney must prove that the Defendant Caused Serious Physical Injury to Another Person by using a Deadly Weapon or Dangerous Instrument.<\/p>\n\n\n\n If you are charged under Subsection (a)(4), also known as the Administration of Stupefying Drugs Subsection, the Essential Elements the State’s Attorney must prove are:<\/p>\n\n\n\n In plain English, this means that the State’s Attorney will have to prove Five things. <\/p>\n\n\n\n First, that the Administered a Drug Capable of producing Stupor, Unconsciousness, or Other Physical Impairment to Another Person. Second, the State’s Attorney must prove that the Defendant Administered the Drug Without Consent of Such Other Person. Third, the State’s Attorney must prove that the Drug Caused Stupor, Unconsciousness, or Other Physical Impairment to Such Other Person. Fourth, the State’s Attorney must prove that the Defendant Specifically Intended to Cause Stupor, Unconsciousness, or Other Physical Impairment to such Other Person. And, finally, the State’s Attorney must prove that the Defendant had No Lawful Purpose in administering the Drug to such Other Person.<\/p>\n\n\n\n If you are charged under Subsection (a)(5), also known as the Board of Parole Employee or Member Subsection, the Essential Elements the State’s Attorney must prove are:<\/p>\n\n\n\n In plain English, this means that the State’s Attorney will have to prove Three things. First, that the Defendant was on Parole at the time of the Assault. Second, the State’s Attorney must prove that the Defendant Specifically Intended to Cause Physical Injury to Another Person that he or she Knew to be an Employee or Member of the Board of Parole. Finally, the State’s Attorney must prove that the Defendant actually Caused Physical Injury to Such Other Person who was a Board of Parole Employee or Member.<\/p>\n\n\n\n If you are charged under Subsection (a)(6), also known as the Knockout Subsection, the Essential Elements the State’s Attorney must prove are:<\/p>\n\n\n\n In plain English, this means that the State’s Attorney will have to prove Three things. First, that the Defendant Specifically Intended to Cause Serious Physical Injury to Another Person by Rendering that Other Person Unconscious. Serious Physical Injury means physical injury which creates a substantial risk of death, or which causes serious disfigurement, serious impairment of health or serious loss or impairment of the function of any bodily organ. In addition, the State’s Attorney must prove that the Defendant Caused Serious Physical Injury to Such Other Person by Striking that Person on the Head. And, finally, the State’s Attorney must prove that the Defendant was Not Provoked by the Person he or she Assaulted.<\/p>\n\n\n\n If you are charged under Subsection (a)(7), also known as the Striking or Kicking the Head of a Prone Person Subsection, the Essential Elements the State’s Attorney must prove are:<\/p>\n\n\n\n In plain English, this means that the State’s Attorney will have to prove Two things. First, that the Defendant Specifically Intended to Cause Physical Injury to Another Person.
