The Essential Elements of Sexual Assault in the First Degree under subsection (a)(3) are:

  • Committed Sexual Assault in the Second Degree
  • Aided by Two or More Other Persons

In plain English, this means that the State’s Attorney will have to prove that the Defendant committed the crime of Sexual Assault in the Second Degree, and that the Defendant was aided or helped by Two or More other people when he or she committed the crime of Sexual Assault in the Second Degree.

The Essential Elements of Sexual Assault in the First Degree under subsection (a)(4) are:

  • Sexual Intercourse
  • Mentally Incapacitated Person

In Plain English, this means that the State’s Attorney will have to prove that the Defendant engaged in Sexual Intercourse with another person, and that the Other Person with whom he or she engaged in Sexual Intercourse was mentally incapacitated by drugs, liquor, or some other means to the point that he or she could not consent to Sexual Intercourse.
